ACKNOWLEDGEMENT OF RISK

I acknowledge that:-

EarthWalks is a business devoted to bushwalking, observing bushwalking, and training to bushwalk ("bushwalking").
The physical activities associated with bushwalking constitute a "dangerous recreational activity" as defined in Section 18 of the Civil Liability Act 2003.
That bushwalking carries with it the risk of injury, loss and damage to person and property.
That this Legal Release Indemnity and Disclaimer is a legal document which has the effect of precluding me from exercising any rights that I may have for damages for bodily injury or property damage arising from bushwalking activities facilitated by EarthWalks.
I undertake the activities associated with bushwalking at my own risk and voluntarily assume that risk
I acknowledge that the activity of bushwalking includes but is not limited to:-

Participation in activities organised and controlled by EarthWalks.
Participating in training activities organised by EarthWalks.
The utility of any equipment, resources, organised, provided by, or controlled by EarthWalks.
The consumption of food and liquid provided by EarthWalks.
The crossing on foot of all types of environments and terrains, in all types of atmospheric conditions.

RELEASE INDEMNITY AND DISCHARGE AND DISCLAIMER

In the context of the acknowledgements referred to herein, should I suffer any loss, bodily injury, damage to property, or other consequential losses, I HEREBY ACKNOWLEDGE AND AGREE THAT:-

(a) I forever release discharge and acquit EarthWalks, its owners, directors, staff and contractors from any such loss.

(b) This document may be pleaded in discharge to any claim, suit, demand, or action I may have against EarthWalks for any loss of any kind I sustain whilst participating in any EarthWalks bushwalking.
